چکیده
این پژوهش با هدف بررسی و تحلیل تأثیر اتکازات عرفی در استنباط احکام فقه عبادات سامان یافته است. پرسش اصلی پژوهش حاضر آن است که «ارتکازات چه تأثیری در استنباط احکام فقه عبادات دارند؟» یافته‌های پژوهش حاکی از آن است که شارع مقدس در بیان احکام و همچنین معارف دینی به ارتکاز و فهم مردم از واژگان توجه داشته است و کلمات به‌کاررفته در لسان روایات و ادلۀ شرعی را در همان معانی عرفی خود به کار برده است. شارع حکیم اگر در جایی تأسیس جدیدی دارد که عرف در آن خصوص فهم دیگری دارد یا اساساً برای عرف ناآشناست، اقدام به تبیین و تعریف ابعاد و زوایای آن واژۀ تأسیسی کرده است. بنابراین اصل در فهم واژگان متون دینی، فهم عرف است و آنچه در ارتکاز عرف از معنای واژگان نقش بسته است معیار برای تفسیر و استنباط است. از جمله مهم‌ترین نتایج این پژوهش آن است که «ارتکاز عرف» قرینۀ لُبّی است که در هنگام تفسیر و استنباط حکم از ادلۀ شرعی باید مورد لحاظ قرار گیرد. روش پژوهش توصیفی- تحلیلی است.

The purpose of this research is to examine and analyze the effect of concentrations in the jurisprudence of worship. This research was conducted using a library study method and a descriptive-analytical approach, in which the necessary information was obtained and analyzed by referring to evidence and jurisprudential texts.The main question of the present study is: "What effect do references have on the inference of the rulings of the jurisprudence of worship?" The findings of the study indicate that the holy lawgiver, in expressing the rulings and also religious teachings, paid attention to the people's reference and understanding of the words, and used the words used in the language of narrations and religious evidence in their customary meanings.If the wise legislator establishes a new term in a place where the common custom has a different understanding or is fundamentally unfamiliar to the common custom, he has attempted to explain and define the dimensions and angles of that established term. Therefore, the principle in understanding the words of religious texts is the understanding of the common custom, and what is embedded in the common custom's concentration of the meaning of the terms is the criterion for interpretation and inference.Among the most important results of this research is that the "reliance on custom" is a logical argument that must be taken into account when interpreting and deducing a ruling from religious evidence.
