چکیده
تبیین پایهها و سازههای فقه مقاومت در شرایط کنونی، با توجه به هجمههای گستردۀ فرهنگی، از منظر معرفتی ضرورتی فوری به شمار میآید. پرسش اصلی آن است که اصول هویتی فقه مقاومت، مبتنی بر مبانی معرفتشناختی مستند به آیات، روایات و دیدگاههای صاحبنظران چیست؟ این پژوهش با روش توصیفی ـ تحلیلی و بر پایۀ منابع کتابخانهای، با هدف فراهمسازی زمینه برای گفتمانسازی مقاومت، به پرسش یادشده پاسخ داده است. یافتهها نشان میدهد این سازه بر اصول و بنیانهایی همچون اصل مشروعیت مقاومت، عمومیت و اطلاق مقاومت بهصورت وجوب بر همگان، وجوب پشتیبانی از مقاومت، وجوب نصرت امام عادل و شمول احکام مقاومت نسبت به مناهج نظامی و مدنی استوار است. این اصول که برگرفته از آیات و روایات و متجلی در فتاوای فقیهان امامی است، بر مبانی معرفتی هستیشناختیای همچون حقیقت مقاومت در نظام تکوین و تشریع، نزاع دائمی حق و باطل، کرامت ذاتی و مسئولیت انسان، ولایتمداری و پیوند با ارادۀ الهی، و اقامۀ عدل و قرب الهی بهعنوان غایت مقاومت مبتنی است و هویت فقه مقاومت را شکل میدهد و از فتاوای فقیهان در این حوزه پشتیبانی میکند. بر این اساس، میتوان عقلانیت و ابتنای فقه مقاومت بر اصول روشن فکری و معرفتی را تبیین و همگان را در گسترهای وسیع بدون در نظر گرفتن نژاد، رنگ و عقیده به حمایت از مظلوم دعوت نمود.

Explaining the foundations and structures of resistance jurisprudence in the current conditions, given the widespread cultural attacks, is an urgent necessity from an epistemological perspective. The basic question is what are the identity principles of resistance jurisprudence based on epistemological foundations documented in verses, narrations, and the words of experts? This research has answered the above question with a descriptive-analytical method, based on library resources, with the aim of providing a basis for discursive formation of resistance. The findings show that this structure is based on principles and foundations such as: the principle of legitimacy of resistance, the generality and applicability of resistance as an obligation for everyone, the obligation of supporting resistance, the obligation of supporting the just Imam, and the inclusion of resistance laws in military and civil methods. These principles, which are derived from verses and narrations and manifested in the fatwas of Muslim jurists, have ontological epistemological foundations such as: the reality of resistance in the system of creation and legislation, the constant conflict between right and wrong, the inherent dignity and responsibility of man, guardianship and connection to the divine will, and the establishment of justice and divine nearness as the goal of resistance. They constitute the identity of the jurisprudence of resistance and support the fatwas of jurists in this regard. On this basis, the rationality and reliance of the jurisprudence of resistance on clear intellectual and epistemological principles can be explained and everyone can be invited to support the oppressed.
